Notice of Proposals NOTICE IS HEREBY GIVEN that Wigan Borough Council, in exercise of the powers under Section 32 (1) and 35(1) of the Road Traffic Regulation Act 1984 and Part IV of Schedule 9 to the Act and all other enabling powers, proposes to make the Wigan Borough (Off Street Parking Places) (Loire Drive, Derby Street and Harrogate Street Car Parks) (Electric Vehicles Recharging Parking Bays Amendment) Order 2020. The effect of the Order will be to authorise the installation of electric vehicle recharging parking bays in:
NOTICE IS HEREBY GIVEN that Wigan Borough Council, in exercise of the powers under Section 32 (1) and 35(1) of the Road Traffic Regulation Act 1984 and Part IV of Schedule 9 to the Act and all other enabling powers, proposes to make the Wigan Borough (Off Street Parking Places) (Loire Drive, Derby Street and Harrogate Street Car Parks) (Electric Vehicles Recharging Parking Bays Amendment) Order 2020. The effect of the Order will be to authorise the installation of electric vehicle recharging parking bays in:
? Loire Drive Car Park, Wigan

? Derby Street Car Park, Tyldesley

? Harrogate Street Car Park, Wigan

There will be limited exceptions permitting vehicles to wait -
The vehicle is waiting owing to the driver being prevented from proceeding by circumstances beyond his control or to such waiting being necessary in order to avoid an accident; the vehicle is being used for fire brigade, ambulance or police purposes; the vehicle is needed for the maintenance, cleansing, improvement or reconstruction of the car park of which contains the said electric vehicle recharging parking bay; and getting or giving help in consequence of an accident or an emergency, or otherwise taking action for public safety.
The Order also provides that if any vehicle is left in any road or length of road affected by the Order in contravention of any provision of the Order a penalty charge (in the amount set by the Council) shall be payable and/or the vehicle may be removed.
A copy of the proposed Order, the Order to be amended and a statement of the reasons for proposing to make the Order may be inspected at the Town Hall, Library Street, Wigan, between 9am and 4:30pm on any day from Monday to Friday. Any objection to the Order must be made in writing and specify the grounds thereof and must be made to the Assistant Director - Legal, Town Hall, Library Street, Wigan quoting reference RD/LS/SEC/ CL48.561 not later than 27th March 2020.
